Terms and Conditions

These terms and conditions will apply to the purchase of any goods by you as the customer (‘Customer’) on Holly Clark Editions and related pages (the ‘Website’). Holly Clark Editions, trading name is Holly Clark Photography, registered at 3 Tunnel Mews, Knock Lane Blisworth, Northampton, NN7 3DA.

The Customer must be a minimum age of 18 years to order via the Website. The Website reserves the right to deny or change a Customer’s order (e.g. if the Customer has provided incorrect personal data).

We reserve the right, on our sole discretion, to update or revise these Terms and Conditions.

The use of Holly Clark Editions and/or a purchase through the Site indicates full acceptance of these terms and conditional.

The Website and all its content is owned by Holly Clark Editions. The information is protected by intellectual property and marketing legislation, inclusive of branding, company names, product names, images, graphics, design, product descriptions and other content may not be copied or used without the prior written consent of Holly Clark Editions.

Goods

The imagery and descriptions of the Products is as set out in the Website or other form of advertisement. Any description is for illustrative purposes only. Such illustrations do not guarantee to reproduce the exact appearance of the product.

In the case of any Products made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.

All Products which appear on the Website are subject to availability.

We can make changes to the Products which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

Holly Clark Photograph shall have no liability in case products are sold out, nor for image or typographical errors on the Website e.g. errors in the product description or specification, inaccurate prices and price adjustments (such as changed prices from suppliers, change in currencies) or incorrect information with regards to whether a product is in stock. Holly Clark Editions is entitled to rectify any such errors and, at any time, to change or update the information.

Basis of Sale

The description of Products on the Website does not constitute a contractual offer to sell the Products. When an order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.

The order process is set out on the Website. Each step allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.

A contract will be formed for the sale of Products ordered only when you receive an email from us confirming the order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately if any errors. We are not responsible for any inaccuracies in the order placed by you. By place an order you agree to us giving you confirmation of the contract by means of an email with all information in it. You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not latter than the delivery of any Goods supplied under the contract.

No variation of the contract, whether about description of the Products, fees or otherwise, can be made after it has ben entered into unless the variation is agreed by the Customer and Holly Clark Editions in writing. 

Price and Payment 

The price of the Product and any additional delivery or other charges is that set out on the Website at the date of the order or such other price as we may agree in writing. All prices are in Great British Pounds and include VAT. The prices do not include payment and shipping fees, which are given separately.

Payment must be made at the time of purchase to complete your order.

Special Offers

Holly Clark Editions may from time to time provide special offers on the Website which may have more favourable conditions than those set forth in these General Conditions – for example, reduced pricing or free shipping. Such conditions will apply for the duration of the special offer and for the specific products set forth by Holly Clark Editions. We reserve the right, at any time, to withdraw such special offers. Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments. Any offers on specific products on the Website are valid only for a limited period of time.

Gift Cards

Gift cards sold by Holly Clark Editions are valid for 18 months from the date of issue and can be redeemed on Holly Clark Editions Website. After the expiry date, the card cannot be used as payment or reactivated, nor can any remaining value be reimbursed. Your gift card constitutes legal tender at Holly Clark Editions and must be stored securely. Gift cards cannot be exchanged for cash. Lost or stolen cards will not be replaced.

Delivery

We will always endeavour to deliver the Product to the delivery location by the time or within the agreed period or, failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the contract entered into. 

If Holly Clark Editions, for reason out of their control, is unable to deliver within this time period, no further liability will be taken.

For delivery outside of the United Kingdom, the Customer will be liable to pay for any local import duties and/or taxes. 

The Customer agrees we may deliver the Products in instalments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.

If you or your nominee fail, through no fault of ours, to take delivery of the Product at the delivery location, we may charge the reasonable costs of storing and redelivering them.

The Product will become your responsibility from the completion of delivery or Customer collection.

Right of Refund

Due to the custom nature of Holly Clark Editions, we have a non-refundable policy. Items are not able to be returned. Exception will be made, if you received the wrong order or your order is damaged.

Privacy Policy

This privacy policy sets out how Holly Clark Editions uses and protects any information that you give Holly Clark Editions  when you use this website.

Holly Clark Editions is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

Holly Clark Editions  may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from November 2020.

Holly Clark Editions  takes our clients’ and our website visitors’ privacy seriously. We will never sell, rent or disclose your personal information to any third party without your consent. Unless you give Holly Clark Editions express permission to act otherwise, the following privacy policy will guide the way we treat any personal information provided to us on this website.
